The point I made about the state AGs having the POWER to opt out of the national scheme (or to, for example, adopt it but add an R18 rating in their state) is entirely correct. The National Code is an agreement between the state AGs, and nothing more. If one of them is being a spoiler - ie, Atkinson - the others could go around him. It wouldn't even need to be messy - they adopt the code, but they also permit the sale of games rated for adults. It's state law that enforces the code, and state governments have the power to change that.
The political question is something else, of course, but in essence - the various state AGs could, if they chose, implement an R18 rating. It's politically convenient to blame it all on Atkinson and not rile up the nanny staters, of course - unless people realise that the only power Atkinson has in other states is that power that those states' attorneys-general choose to give him.
