Nintendo have gone after a Brisbane local after he pirated New Super Mario Bros Wii. and uploaded it to the internet a week before its official release. The Australian Federal court has ordered 24 year old James Burt to pay $1.5 Million for damages.

I doubt most readers of AG follow the latest happenings in our legal system. But this is one case most readers definitely know about. The Movie Studio Cartel vs iiNet. The lawsuit is being brought against iiNet by a cartel of 34 copyright holders determined to hold the ISP responsible for the actions of those who use their service. In my opinion, this is like suing Australia Post for someone posting copied DVDs, or the electricity company for supplying the electricity used to burn them.

Well, the verdict is in, iiNet has won. Below are some excerpts of the ruling courtesy of itnews.com.au. "the mere provision of access to internet is not the means to infringement", "iinet has no control over bittorrent system and not responsible for bittorrent system.","I find that iiNet simply can't be seen as approving infringement". The fact there is worldwide piracy "does not necessitate or compel a finding of authorisation, just because it is felt there is something that must be done." "copyright occured as result of use of BitTorrent, not the Internet" said Justice Cowdroy

If you're like most Xbox 360 owners, your console has died with the dreaded Red Ring of Death error. Literally every person I know with an Xbox 360 has had their's either replaced (often multiple times) or repaired since buying the console when it came out in 2006. Even those consoles which died outside of Microsoft's standard 12 month warranty ended up getting theirs repaired under the extended 3 year warranty announced specifically to cover the dreaded RROD.

For many of us, since having our consoles repaired we've had 3 years of non-stop gaming pleasure. That is, until now! A good friend of mine who will call "Shane", has just had is previously repaired Xbox 360 die...again. Same Red Ring of Death, same symptoms, same result. This time, however, it's out of Microsoft's already extended warranty. Microsoft's response to him, $150 to have it repaired. Even though it is the same error on the same machine that already was supposedly fixed , this time the consumer has to pay to have their dodgey console repaired!

Episodes from Liberty City coming soon for PS3

While we're being Rockstar's PR bitches, it was just announced that Episodes From Liberty City, the two DLC packs for Grand Theft Auto 4 are now to be made available to PS3 and PC owners. In case you didn't know, Microsoft paid $50 million dollars to have the DLC for GTA4 exclusive to the 360. I was never able to determine if this was a limited time thing or if it was infinite. Well, I guess now we know!

For PS3 (and PC, but whatever) GTA4 owners, Episodes From Liberty City will be available for you to download individually or buy as a pair from March 30.
